HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.3480 OF 2018 ORDER: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner has challenged the order dated 18.01.2018 passed in O.A.No.23 of 2018 whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act 1985 has been dismissed.

The case of the petitioner is that he belongs to Scheduled Caste community and has studied up to 10th class and his name was registered with 4th respondent office with registration No.K1/2012/00851 dated 31.01.2012 and the same is in live roles of the District Employment Exchange. He came to know that some of the persons whose names were registered with 4th respondent have issued call letters by the 4th respondent officer in response to the requisition made by the 2nd respondent to fill up the post of LASKAR which had fallen vacant and the same is liable to be filled by the reserved category persons. After knowing the same the petitioner has approached the 4th respondent and made a request to sponsor his name for recruitment of the post of LASKAR within the jurisdiction of the 2nd respondent. But the 2nd respondent informed that the sponsoring of the candidates whose names are enrolled with the 4th respondent will be

issued call letters basing on their seniority of registration and also further informed that his name is not coming within the zone of consideration for sponsoring.

3. As stated by the learned counsel for the respondent that the post of LASKAR is one (01) and they have called 20 candidates from the employment exchange.

4. Since the seniority in the employment exchange of the petitioner is in a lower side therefore the name of the petitioner has not been sent by the District Employment Officer for the above said post.

5. Keeping in view the fact that the post is one (01) and 20 candidates have been sponsored, therefore we find no reasons to interfere with the order dated 18.01.2018 passed in O.A.No.23 of 2018 by the learned Tribunal.

6. Finding no merit in the instant petition and the same is accordingly dismissed. There shall be no order as to costs. Miscellaneous Petitions, if any pending, shall stand closed.
