THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2127 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ accused C.C.No.690 of 2015 on the file of Additional Munsif Magistrate at Mangalagiri, Guntur District, arising out of a private complaint filed by the first respondent herein, wherein he is facing the trial for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.
Heard the learned counsel for the petitioner and the learned Pubic Prosecutor.
After arguing for sometime, the learned counsel for the petitioner, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court. Learned counsel further stated that the identity of the petitioner is not questioned and is not disputing before the trial Court.
In any event, considering the facts and circumstances of the case, the presence of the petitioner before the trial Court is dispensed with except on the dates when the Court insists for the same and the petitioner shall be properly represented by his counsel.
With the above observation, this criminal petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed. _________________
