SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1204 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.4, in Crime No.736 of 2017 on the file of the Station House Officer, Hayathnagar Police Station, Rachakonda District. 2.
The offence alleged is under Section 387 of I.P.C. 3.
Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.
As per the case of the prosecution, the petitioner/accused No.4 was handed over Rs.50,000/- to hand over the same to some other accused in this crime. But the learned Public Prosecutor brings to the notice of this Court the earlier bail application filed by the petitioner in Criminal Petition No.11066 of 2017. A perusal of the order shows that considering that this petitioner is aware of the conspiracy and that he is alleged to have contacted accused No.2 regarding causing the murder of L.W.1, dismissed the Criminal Petition. 5.
Learned counsel for the petitioner now submits that there is absolutely no such allegation in the remand report. It is, however, stated by the learned Public Prosecutor that the cell phone of the petitioner was seized. Learned Public Prosecutor also brings to the notice of this Court about the involvement of the petitioner in another Crime No.32 of 2016 on the file of the Station House Officer, Pochampalli Police Station, Nalgonda District, registered for the offences under Sections 506 and 448 R/w.34 of I.P.C.

Hence, considering the above, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner/accused No.4 is directed to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, on merits, preferably on the same day, subject to pressure of other work.
Accordingly, with the above observation, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
