This writ petition is filed for a mandamus declaring the action of the 2nd respondent in not disposing of O.A.No.747 of 2011 as arbitrary, illegal and contrary to law and for a consequential direction to the 2nd respondent to dispose of O.A.No.747 of 2011.

The grievance of the petitioners is that they filed O.A.No.747 of 2011 before the 2nd respondent seeking a declaration that the 3rd respondent cannot act as hereditary trustee of Sri Vigneswara Swamy Vari Devastanam as she has no faith in the God and is spoiling the atmosphere of the temple and she cannot be considered as member of the founder's family. It is also stated that as the 3rd respondent has been acting contrary to the interest of the institution, the petitioners requested the 2nd

respondent to take up the matter expeditiously, but in spite of their best efforts, even though the matter is one of oldest matters on its file and the evidence of the petitioners was filed on 27-12-2012, the 2nd respondent has not taken up the matter for disposal. Aggrieved by the same, the present writ petition is filed. 3.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Endowments.

4. Having regard to the facts and circumstances of the case, since it is stated that O.A.No.747 of 2011 is of the year 2011 and the petitioners have already filed their evidence on 27-12-2012, the 2nd respondent can be directed to dispose of O.A.No.747 of 2011 pending on its file.

Accordingly, the writ petition is disposed of directing the 2nd respondent-Tribunal to consider and dispose of O.A.No.747 of 2011 pending on its file, as expeditiously as possible, keeping in view the pendency on its file. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
