HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.3330 of 2018 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration for respondent No.1 and Sri M. Balaji, learned Standing Counsel, offers from the oral instructions on behalf of respondent Nos.2 and 3 and perused the prayer in the writ petition with supporting affidavit and other material on record.

The prayer in the writ petition reads as follows: "........to issue a writ, order or direction more particularly one in the nature of a writ of mandamus declaring the impugned in action of the respondents in considering the representation made by the petitioner on 26.12.2017 to the 2nd respondent is arbitrary, illegal, capricious, high handed and is in violation of the fundamental rights guaranteed to the petitioner under Article 14 and 21 and the guarantee to the petitioner under Article 300 A of the Constitution of India apart from being in violation of the principles of natural justice and fair play and consequently direct the respondents to remove the commercial establishments in the ground floor of Rohini Apartments, Dooro No.46-3/1-46/2, Koneru Lakshmaiah Street, Mogalrajupuram, Vijayawada, Krishna District as they are contrary to approved plan and pass such other order or orders as may be deemed fit and proper in the circumstances of the case."

The learned Standing Counsel submits that respondent Nos.2 and 3 are going to consider the representation of the petitioner and take appropriate steps according to law.

Accordingly, the Writ Petition is disposed of to show the progress of the consideration of the representation and steps taken preferably within four weeks from the date of receipt of a copy of this order by communication to the petitioner.
Miscellaneous petitions pending, if any, shall stand closed. No costs.
