HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9362 OF 2015 O R D E R :
This writ petition is filed for a Mandamus declaring the action of the respondents in not disposing of the representations dated 09.04.2014, 29.09.2014, 15.10.2014, 27.02.2015, 23.03.2015 and 30.03.2015, and in not taking any steps for removing the encroachments on the road leading to Road No.5 and 7, situated in East Yadav Nagar Colony at Yadav Nagar, as illegal and arbitrary and for a consequential direction to the respondents to dispose of the representations filed by the petitioner.
The case of the petitioner association is that the members of the petitioner association purchased residential plots in Yadav Nagar and constructed houses long back after obtaining due building permission. They are also paying property tax, electricity charges and also water charges. While so, some unsocial elements and land grabbers with an intention to construct a wall, blocked the road leading to road No.5 and 7, by dumping load of granite in the middle of the road which is causing great hardship to the residents of the East Yadav nagar Colony. Though, the petitioner-Association submitted several representations to respondents 1 and 2, they did not take any steps for removing the blockage of the road. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioner.
Ms.A.Deepthi, learned Standing Counsel for respondents 1, 2 and 4 submits that since the grievance was already ventilated before the concerned authorities, it is for them to take action in accordance with law. In view of the above, there shall be a direction to the 2nd respondent to
consider and dispose of the representations submitted by the petitioner and take action in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
