THE HONOURABLE SMT JUSTICE ANIS CRIMINAL PETITION No.14133 of 2016

ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 and A2 seeking to quash the proceedings in Cr.No.379 of 2016 of Nellore V Town Police Station, SPSR Nellore District, registered for the offences punishable under Sections 290, 506 r/w.34 IPC and under Sections 3(1)(r)(s) of SCs & STs (POA) Amendment Act, 2015, against them.

Heard learned counsel for the petitioners/accused and learned Additional Public Prosecutor representing the State.

The second respondent lodged a report alleging that on 13.09.2016 near Railway gate, Nellore, all the accused abused her in filthy language in the name of her caste in public view and threatened her with dire consequences due to financial disputes. Based on the complaint, the aforesaid case was registered.

4. Learned counsel for petitioners argued that the petitioners are innocent and they have not committed any offence. He further argued that there is a civil dispute between the parties and the present complaint is filed as a counter blast.

5. Learned Additional Public Prosecutor submitted that certain allegations are made against the petitioners and the police registered the case under SCs & STs (POA) Act against them.

6. In view of the specific allegations against the petitioners, this Court cannot interfere with the investigation at this stage. However, the petitioners are directed to surrender before the Special Court and move an application for bail, and on filing such an application, the Special Court is directed to grant bail on the same day or next day.

With the above direction, the Criminal Petition is disposed of. Miscellaneous applications, if any, pending in this criminal petition shall stand closed.
