THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.2215 OF 2016 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed seeking to direct respondent No.1 -Tribunal to dispose of S.A.No.306 of 2015 preferred by respondent No.2.
A copy of the aforesaid appeal filed by respondent No.2 under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 is placed on record. From a perusal of the same, it is clear that the said appeal is filed questioning the sale notice, dated 05.04.2015, issued by the petitioner - Bank.
During the course of hearing, it is brought to our notice that in view of the status quo orders passed in the said appeal, which continued all along, the auction scheduled to be held on 06.05.2015, pursuant to the sale notice, dated 05.04.2015, was not held and the petitioner is not able to take any further steps.
As the appeal is filed questioning the sale notice, dated 05.04.2015, and in view of the status quo orders passed by respondent No.1, as no auction was held as scheduled, we deem it appropriate to dispose of this Writ
Petition by directing respondent No.1 - Tribunal to dispose of the appeal itself within a period of one month from the date of receipt of a copy of this order. Subject to the above, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
