HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3904 OF 2017 ORDER:

Though, Sri M. Ajay Kumar, learned counsel for the petitioner, seeks a direction to the police to follow the procedure under Section 41A of Cr.P.C., by fairly coming forward that the petitioner's name is not yet figured in any of the crimes, nor any crime is registered against him, but only on the ground that police concerned are calling the petitioner. Certainly, such a relief cannot be granted, as the learned Additional Public Prosecutor would submit that no complaint at all was received against the petitioner so far. The present Criminal Petition is, accordingly, dismissed. As a sequel, miscellaneous petitions, if any, pending in this petition shall stand closed.
