Mukunda Venkataiah v. State Of Telangana,
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3343 of 2018 O R D E R:
Petitioner's grievance is that the respondent authorities are not allowing him to complete the construction notwithstanding the fact that he was granted permission on 24.01.2017 and the same is valid up to 23.01.2019. He contends that the respondent authorities are obstructing the petitioner from making construction without issuing any notice and without taking steps in accordance with law even assuming that there is violation on his part. Sri G.Narender Reddy, learned Standing Counsel for the Gram Panchayat submits that the Gram Panchayat has no objection if the petitioner makes construction in accordance with the sanctioned plan. It is only on noticing that the petitioner is trying to construct a pillar in the drainage, which would obstruct free flow of the water, he was warned not to make such constructions. He further submits that as long as the petitioner adheres to make construction in accordance with the sanctioned plan, there can be no objection.
Having regard to the above, the writ petition is disposed of with the direction to the respondent authorities not to interfere with the construction of the petitioner subject to his adhering to the sanctioned plan and not making any construction in the drainage.
Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:06.02.2018 kdl
