O R D E R

The grievance of the petitioners is that the Tahsildar, Shaikpet Mandal, Hyderabad, is not disposing of the case which was remanded to his file by the Joint Collector, Hyderabad District, vide order dated 10.07.1998. The Joint Collector passed the said order in exercise of appellate power under Section 90 of the Andhra Pradesh Tenancy and Agricultural Lands Act, 1950.

By the said order, the appellate authority set aside the earlier order of the Tahsildar, which was passed in the year 1996 without affording an opportunity of hearing to all the parties concerned, and directed the Tahsildar to complete the enquiry and pass orders afresh within a time frame. Till passing of such orders, status quo was directed to be maintained.

Learned Assistant Government Pleader for Revenue would inform this Court that the Tahsildar, Shaikpet Mandal, is yet to pass orders in the matter.

It is not open to the Tahsildar to ignore the time stipulation fixed by the appellate authority in an order passed as long back as in the year 1998.

The writ petition is accordingly disposed of directing the Tahsildar, Shaikpet Mandal, to pass orders in Case No.C/5703/1993 in terms of the remand order dated 10.07.1998 expeditiously and in any event, not later than three months from the date of receipt of a copy of this order, be it from whatever source.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _______________ SANJAY KUMAR, J 11th JUNE, 2019 Svv
