ORDER

The instant petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'the Code'), requesting to quash the proceedings in C.C.No.253 of 2014 on the file of XIII Additional Chief Metropolitan Magistrate, Nampally at Hyderabad, for the offences punishable under Sections 420, 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act, against the petitioners-A1 to A3.

The averments in the complaint as well as the charge sheet would reveal that certain allegations in the direction of causing harassment to the first respondent-de facto complainant were levelled, and in fact, the de facto complainant filed O.P.No.441 of 2014 on the file of Family Court, Ranga Reddy District at L.B.Nagar, under Section 13(1)(ia) of Hindu Marriage Act, 1955, for dissolution of marriage by granting a decree of divorce.

3. Heard both sides and perused the material on record.

4. Learned counsel for the petitioner submits that, though, the present petition is filed to quash the proceedings, still, only to the extent of dispensing with the appearance of petitioners 2 and 3 on account of their old age, may be acceded to.

5. Learned Public Prosecutor opposed the application.

6. Keeping in view, the age of petitioners 2 and 3 and having regard to the circumstances of the case, the appearance of petitioners 2 and 3 is dispensed with during the pendency of the proceedings in C.C.No.253 of 2014 on the file of XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. However, they shall appear before the said Court as and when the learned Magistrate directs.

7. With the above direction, the Criminal Petition is disposed of.

8. As a sequel thereto, miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
