HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRL.R.C.M.P.No.1455 of 2017 IN/AND CRIMINAL REVISION CASE No.894 of 2017 COMMON ORDER :

Crl.R.C.M.P.No.1455 of 2017 is filed under Section 5 of the Limitation Act to condone delay of 278 days in preferring the revision.

The revision is filed against the order, dated 24.03.2016, passed by the Additional Judicial First Class Magistrate, Sangareddy, in M.C.No.28 of 2014, alleging that the order was pronounced on 24.03.2016 and the copy application was made on 02.03.2017 and the copy was made ready by 02.03.2017 and delivered on the same day. After pronouncement of judgment, the petitioner became sick and suffered from typhoid could not move from his house and, therefore, he could not file the revision within the time allowed by law and prayed to condone delay.

It is a strange case where the petitioner suffered from typhoid for 278 days and he did not produce any piece of paper to show that he was suffering from any ill-health which prevented him from filing the revision before this Court. In the absence of any medical certificate and data regaining ill-health, it is difficult to accept such bald allegation made in the affidavit. Therefore, I find no ground to condone abnormal delay of 278 days in filing revision petition.

Accordingly, Crl.R.C.M.P.No.1455 of 2017 is dismissed. Consequently, Crl.R.C.No.894 of 2017 is rejected. 5.
