THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3286 of 2018 ORDER:

This Writ Petition is filed challenging the action of the fourth respondent in issuing proceedings dated 24.01.2018 without hearing the petitioners and directing the Tahsildar to delete the names of the petitioners from the Webland Adangal and 1B Register for insertion of 'Govt Land' in the relevant register and to remove the fencing and safeguard the land and promulgate criminal proceedings under Section 145 Cr.P.C. to avert the encroachments.

Since there is a provision of appeal against the impugned order, this Court is not inclined to entertain the present Writ Petition, but gives liberty to the petitioners to avail such remedy before the competent authority. Since there is a threat of dispossession pending invocation of that remedy, the impugned order, dated 24.01.2018, shall not be implemented for a period of thirty (30) days to enable the petitioners to avail the remedy of appeal.

Accordingly, the Writ Petition is, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
