Crl.P.M.P.Nos.9498 and 9499 of 2017 Crl.P.M.P.No.9498 of 2017 is filed under Section 320 (6) of Criminal Procedure Code (for short "Cr.P.C.") to permit the petitioner/respondent No.2 to compound the offence punishable under Sections 498-A, 406 and 313 of Indian Penal Code (for short "I.P.C.") and under Sections 4 and 6 of Dowry Prohibition Act. Crl.P.M.P.No.9499 of 2017 is filed under Section 320 (2) of Cr.P.C. to record the compromise between the parties. Learned counsel for the petitioners submits that both the parties entered into compromise voluntarily; reduced the same into writing and the complainant has taken all her gold, silver and Jehaz articles.
Both parties are present in-person before this Court and they are identified by their respective counsel and produced Photostat copies of aadhaar cards in proof of their identity. When terms of compromise are explained in vernacular language, they admitted that they entered into compromise voluntarily and decided to live separately.
As the compromise entered by the parties is voluntary and the said compromise has no societal impact; I find that it is a fit case to permit the petitioner to compound the offences.
MSM,J Crlp_8839_ 2017 Accordingly, both petitions are allowed.
Crl.P.No.8839 Of 2017 In view of the orders passed in Crl.P.M.P.Nos.9498 and 9499 of 2017, the present criminal petition is allowed. No costs. Consequently, miscellaneous applications pending if any, shall stand dismissed. No costs.
