THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.30098 of 2017 ORDER:

Heard learned counsel for the petitioner. None appears for the 2nd respondent or any counter-affidavit is filed in spite of taking time on 06.09.2017. Since the relief sought for in the present Writ Petition is innocuous, this Writ Petition is disposed of after hearing learned counsel for the petitioner. 2.

The petitioner states that it is a registered society and membership is open to all washermen, who are doing profession in Madanapalle Town. It is their case that the members of the association are doing their profession in the old Dhobhi Ghat in survey No.229 in an extent of Ac.0.52 cents, near Madhusudhana Talkies (Mokalla Kaluva), Madanapalle Town, Chittoor District. The said Dhobhi Ghat is existing for the last 30 years. The local washermen were eking out their livelihood by utilizing the said land. Though, attempts were made earlier to transfer the land to the petitioner-association, the efforts did not fructify. However, a full-fledged Dhobhi Ghat was constructed and a storage tank was also constructed therein. When the 2nd respondent, all of a sudden tried to remove the Dhobhi Ghat, the petitioner states that it submitted a representation on 04.09.2017 and when no action was taken, the present Writ Petition is filed.

Since it is the case of the petitioner that the members of the petitioner-association have been utilizing the said land for their professional purposes and they are depending on the land, the 2nd respondent is directed to consider the representation of the

petitioner, dated 04.09.2017, and pass appropriate orders, in accordance with law. Till appropriate orders are passed, the land of an extent of Ac.0.52 cents, situated in Survey No.229, near Madhusudhana Talkies (Mokalla Kaluva), Madanapalle Town, Chittoor District, shall not be utilized for any other purpose. However, if the representation of the petitioner is not available, the petitioner shall be issued notice by the 2nd respondent and appropriate action shall be taken by the 2nd respondent, if he decides that the said land shall be utilized for any other purpose. 4.

Accordingly, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
