THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 25150 of 2010 ORDER:- The present writ petition came to be filed seeking issuance of writ of mandamus declaring the notifications issued by respondents 5 and 6 for appointment of dealers for retail outlets, as illegal, arbitrary and contrary to the Minutes of the Meetings held on 17.09.2010 and 18.09.2010, and consequently, to direct the respondents not to appoint dealers for retail outlets, without framing marketing guidelines by the Committee set up, as per the record note of discussions held on 18.09.2010 chaired by the Minister (P & NG) with representatives of Federation of All India Petroleum Traders.

At the time when the matter is taken up for hearing today, the learned counsel for the petitioner submits that in so far as the 2nd part of the prayer is concerned, nothing survives for adjudication, as the dealers for the retail outlets are appointed in the year 2010 itself. In so far as the 1st part of the prayer is concerned, he submits it may be left open enabling the petitioner to ventilate its grievance in an appropriate forum. The learned standing counsel for the respondents did not object for the same.

Having regard to the submissions made and without going into the merits of the case, the writ petition is disposed of holding that no cause would survive in so far as second part of the prayer is concerned and in so far as the first part of the prayer is concerned, it is always left open to the petitioner to ventilate its grievance in an appropriate forum. There shall be no order as to costs. Consequently, miscellaneous petitions if any pending in the writ

petition shall stand closed.
