HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.25423 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioner seeking Mandamus to declare the action of the respondents in reducing the questions from 160 to 153 in A.P. EAMCET-2015 under M.B.B.S./B.D.S. category, for the purpose of securing rank, as illegal and arbitrary.

The grievance of the petitioner is that in EAMCET2015 Examination conducted for grant of admission into M.B.B.S./B.D.S. courses, though 160 questions were framed, each carrying 1 mark, coming to the valuation of answer sheets, the respondents have taken into consideration the answers in respect of only 153 questions, instead of 160 questions, thereby depriving the petitioner for award of 7 marks for the deleted questions.

3. Learned counsel for the petitioner submits that if the remaining 7 questions, which are deleted for the purpose of assessing the ranks, are also taken into consideration, the petitioner was to be awarded 7 marks; however, the marks are reduced in proportion to the deleted questions.

4. On the other hand, Sri A. Prabhakar Rao, learned Standing Counsel for the 2nd respondent-University, on instructions, submits that as the said 7 questions were found to be out of syllabus, they were deleted for the purpose of valuation and as such deletion applies uniformly to all the

candidates, who have appeared for the exam, the petitioner is not entitled to seek addition of marks for the said questions, which were deleted.

5. Having heard learned counsel for the parties, we have perused the material on record.

6. It is not in dispute that out of 160 questions given in A.P. EAMCET-2015 Examination, valuation was done only with regard to 153 questions, fixing the maximum marks as 153 only. This is applicable in respect of all the candidates, who have appeared for the exam. Therefore, the question of addition of 7 marks to the petitioner in respect of those deleted questions will not arise.

7. For the aforesaid reasons, this writ petition is devoid of merits and is accordingly dismissed, at the admission stage. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
