THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6632 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-A.3 under Section 482 Cr.P.C., to quash the proceedings in Crime No.18 of 2016 on the file of Women Police Station, Kadapa for the offences under Sections 498-A, 307, 477, 406 r/w 34 IPC and Sections 3 & 4 of Dowry Prohibition Act. Heard.

On perusal of the entire material available on record, prima facie there are certain allegations as against the petitioner herein and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at the threshold. At this stage, learned counsel for the petitioner submitted that in view of the pendency of the above crime, the petitioner apprehends arrest and also harassment in the hands of the police.

In view of the above, the police concerned are directed to complete the investigation into the crime without arresting the petitioner herein and file a final report, if any, in accordance with law. The petitioner is directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

Accordingly, the Criminal Petition is disposed of. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 27.04.2016.
