THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3332 of 2018 ORDER:

It is the case of the petitioners that they have applied for providing financial assistance notified under S.C. Corporation Plan, 2017. The petitioners were sent messages informing that they were selected and were asked to submit required documents by 20-05-2017. It is averred that the petitioners came to know that without taking any action on their applications, the respondents have called for fresh applications to select the candidates by lottery system and a paper notification to that effect was given in 'Namaste Telangana', Khammam Edition on 31-12-2017. As per the SC Action Plan 2017-18, no lottery system is envisaged for selecting the candidates.

According to the petitioners, keeping aside the list of selected candidates, which was prepared as per the procedure envisaged in Action Plan, is arbitrary and choosing the said method is only to eliminate the selected candidates, including the petitioners which cannot be permitted. Hence, the present writ petition is filed to direct the respondents to release the loan amount to the petitioners forthwith duly cancelling the subsequent selection list, if any, pursuant to the above said paper notification.

It is stated by learned counsel for the petitioners that in similar circumstances, this Court disposed of WP.No.2738 of 2018 by its order dated 31-01-2018.

In view of the same, the Writ Petition is disposed of with the direction to respondents to process the applications of the petitioners and consider granting financial assistance in terms of the scheme, subject to the petitioners fulfilling the conditions laid down under the scheme, and the Rules of the Bank and subject to availability of funds, as expeditiously as possible. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
