Heard learned counsel for the petitioner, learned Government Pleader for Home (Telangana) for respondent Nos. and learned Government Pleader for Prohibition and Excise (Telangana) for respondent Nos.2 to 4.

When the matter is taken up, written instructions dated 10.08.2017, furnished by the Station House Officer, Garla Bayyaram Police Station is placed on record by the learned Government Pleader for Home. In the said instructions, it is stated that during the course of investigation in Crime No.145 of 2017 registered for the offences under Section 7(a) read with Section 8(e) of the A.P. Prohibition Act and Section 34(e) of the A.P.Excise Act, 1968, three witnesses were examined and their statements were recorded and the police kept the subject vehicle with their safe custody and that after getting report from the RFSL, they would handover the subject vehicle to the Excise Department.

It is submitted by the learned Government Pleader for Home that it is open for the petitioner to make an application before the Deputy Commissioner, Prohibition and Excise, Warangal, respondent No.4 herein, for his consideration.

Recording the said statement, the writ petition is disposed of, keeping it open for the petitioner to make an appropriate application before the fourth respondent for release of his vehicle, and if any such application is filed, the same be considered and appropriate orders be passed in accordance with law, as quickly as possible.
