THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO W.P.No.294 of 2015 O R D E R:
The petitioner, while working as an Assistant General Manager with the Industries Development Bank of India, the 1st respondent herein (for short 'the Bank'), has been proceeded against, as a measure of discipline, by the said Bank. The Chief General Manager of the Bank, in his capacity as Disciplinary Authority, has passed Orders on 16/17-04-2014 imposing on the petitioner the penalty of dismissal from service. Against the said order, under Rule 17 of the Discipline & Appeal Rules of the Bank, an Appeal would lie to the Executive Director of the Bank. Accordingly, the petitioner appears to have submitted such an Appeal on 05-06-2014. It is the claim of the learned counsel for the petitioner that the said Appeal has not been disposed of so far by the Appellate Authority. It is also the case of the petitioner that the Appellate Authority has been reminded to deal with the Appeal on 13-092014, but in spite of more than four months' time elapsing thereafter also, there was no response.
Instead of keeping this writ petition pending, the ends of justice would be better served if the 2nd respondent Appellate Authority is directed to deal with the Appeal said to have been submitted by the petitioner on 05-06-2014 on merits as expeditiously as is possible, preferably within a period of six weeks from the date of receipt of a copy of this Order.
With this, the writ petition stands disposed of at the admission stage, but however, without costs.
Consequently, the miscellaneous petitions, if any, stand disposed of.
