THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3322 of 2018 O R D E R :

This Writ Petition is filed to declare the action of the 4th respondent gram panchayat in not giving the leasehold rights of the tanks i.e. 1) Pamulagudam Cheruvu, 2) Brahmam Cheruvu,

3) Yellaiahgunta Cheruvu, 4) Thirupathamma Goyyi Cheruvu and

5) Yeduyathala Daruvu Cheruvu within the jurisdiction of Kavuru Gram Panchayat to the petitioner society for 2018-19, as arbitrary and illegal.

The petitioner claims that it is an existing fisherwoman Cooperative Society and for the previous year 2017-18, they were allowed to carry out fishing operations in the tanks situated at Cherukupally Mandal, Guntur District. In terms of G.O.Ms.No. 546, dated 25.03.1999, it is claimed, the petitioner's society is entitled to conduct fishing operations and it is also to be given preference while granting leasehold rights. It is stated that the petitioner society has also submitted a representation dated 18.12.2017 to the Divisional Panchayat Officer, Tenali to grant leasehold rights in respect of the tanks situated at Kavuru Gram Panchayat. The petitioner therefore, seeks a direction to the respondents to consider their representation in terms of the relevant Government Orders.

Learned Standing Counsel appearing for the 4th respondent gram panchayat submits that the representation of the petitioner will be considered subject to their eligibility and in accordance with the relevant Government Orders.

Recording the said submission, the Writ Petition is disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
