THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.876 of 2016 JUDGMENT: (per Hon'ble the Acting Chief Justice Sri Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, has been preferred against the interlocutory order passed by the Learned Single Judge in W.P.M.P.No.35015 of 2016 in W.P.No.28266 of 2016 dated 26.08.2016. By order dated 19.09.2016, we suspended the interim order passed by the Learned Single Judge on the ground that the 4th respondent-writ petitioner had obtained the interim order suppressing material facts.

Both Sri V.Venkateshwar, Learned Counsel for the appellants and Sri K.Venkata Subbaiah, Learned Counsel for the 4th respondent-writ petitioner, would submit that, after the interim order was passed by this Court, the 4th respondent-writ petitioner withdrew W.P.No.28266 of 2016; and the said Writ Petition was dismissed as withdrawn by order dated 29.11.2016. As this appeal is preferred against the interlocutory order passed in the Writ Petition, and as the Writ Petition itself has been dismissed as withdrawn, the cause in this Writ Appeal does not survive and the Writ Appeal has become infructuous.
