The case of the petitioner is he is claiming succession in respect of subject lands through his paternal grandfather and father and made application on 24-05-2019, 31-09-2019 and 03-09-2019 and several representations. Ultimately, the Tahsildar issued a memo dated 19-09-2019 for conducting enquiry. But as on today, no action has been taken. Aggrieved by the same, the present writ petition is filed. Though the prayer is made for grant of succession certificate, when the same is pointed to learned counsel for the petitioner he could not mention any provision of law for grant of succession certificate. However, he says succeeding the said property the petitioner filed application for mutation in respect of subject lands in his favour being legal heir of his grand father and father.
Heard learned Assistant Government Pleader for Revenue.
Without expressing any opinion on merits, the 4th respondent is directed to take further action in pursuance of memo in Rc.No.B/1727/2019, dated 19-09-2019 in accordance with law.
Accordingly, the writ petition is disposed of. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
