The learned counsel for the 1st respondent/plaintiff would submit that the sole appellant had died long time back and that despite bringing the said fact to the notice of the learned counsel for the appellant, no steps are taken to bring on record the legal representatives of the deceased sole appellant and that the appeal already stood abated by operation of law. Recording the said submission, the Second Appeal is dismissed as abated. No costs.

Miscellaneous petitions, pending if any, in this appeal shall also stand dismissed.
