THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1860 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.2 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.321 of 2015 on the file of the XV Additional Chief Metropolitan Magistrate, Nampally at Hyderabad. Heard and perused the material available on record. It is staged that A1 in the above C.C. is the husband of the de facto complainant and the son of the petitioner-A2. The accused in the above C.C. are alleged to have committed the offences punishable under Sections 498-A and 406 IPC and Sections 4 & 6 of the Dowry Prohibition Act.

Considering the facts and circumstances of the case and the allegations made in the complaint, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, the learned Counsel for the petitioner has submitted that the petitioner is aged about 70 years and therefore, his presence before the trial Court may be dispensed with.

In view of the above submission, the presence of the petitioner before the Court below is dispensed with, except on the dates when his presence is insisted by the Court below. The petitioner shall be represented before the Court below by a Counsel on all hearing dates.

With the above direction, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any,

shall stand closed.
