HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 33151 of 2012 Order:

This writ petition is filed challenging the action of the second respondent in harassing and pressurizing the petitioner to compromise the matter with her husband, to direct the second respondent to arrest her husband and to direct the first respondent to seek explanation from the respondents 2 and 3 as to why they have left her husband without remanding him to judicial custody after arresting and bringing him to Police Station Kushaiguda from Pune.

2. The second respondent filed a counter stating that the petitioner lodged a complaint on 15.07.2012, based on which a case in Crime No.470 of 2012 of Kushaiguda Police Station, under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, was registered and the matter was taken up for investigation. The husband of the petitioner is a Software Engineer working in Pune of Maharashtra State. The Investigating Officer went to Pune and returned to the Police Station along with him.

The husband of the petitioner requested for arrangement of counseling between him and the petitioner. Since the husband of the petitioner was avoiding the police, a letter was addressed to the Commissioner of Police, Cyberabad, on 04.09.2012, requesting him to address a letter to the Additional Director General of Police, CID, Hyderabad, for issuing Lookout Circular. A special team was also constituted for apprehension of the husband of the petitioner. When the efforts were going on, the husband of the petitioner moved bail application No.1551 of 2012 before the Hon'ble High Court of Delhi, which granted anticipatory bail to him. The investigation was in progress as on November 2012.

3. In view of the above facts and in view of the pendency of the investigation, no further relief need be granted in the present Writ

Petition and the Writ Petition is, accordingly, closed. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
