THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.Nos.35736 and 36748 of 2014 and 2110 of 2015 COMMON ORDER :

Heard the counsel for petitioners, and Sri T. Sudhakar Reddy learned Standing Counsel for Andhra Pradesh State Housing Corporation.

2. In all these Writ Petitions the petitioners are questioning termination of contracts granted to them by the Andhra Pradesh State Housing Corporation on certain grounds mentioned in the respective orders of termination, which are impugned in the Writ Petitions.

3. The petitioners dispute the grounds on which the orders of termination of their respective contracts have been passed by 6th respondent, who is an employee of 1st respondentCorporation.

4. Sri T. Sudhakar Reddy, counsel for respondents, however states that petitioners are raising disputed questions of fact which need to be adjudicated on the basis of evidence, and the Civil Court is the competent Forum to decide the same.

5. I find considerable force in the submission of counsel for respondents.

6. Disputed question of facts relating to contractual disputes are not normally decided in Writ Petitions filed under Article 226 of the Constitution of India, and a competent Civil Court can properly

grant appropriate relief to petitioner if he makes out a case for grant of such relief before it.

7. Therefore, granting liberty to petitioners in these Writ Petitions to approach the competent Civil Court for appropriate relief, these Writ Petitions are dismissed. No order as to costs.

8. As a sequel, miscellaneous petitions pending, if any, in these Writ Petitions shall stand closed.
