O R D E R

This court by order dated 27-03-2017 directed the respondents to consider the claim of the petitioners as per their seniority, if any promotions are taken up to the post of Hostel Welfare Officer, Grade-I. Alleging disobedience of the said orders, this contempt is filed. It is the categorical assertion of the respondents that no promotions are taken up after the orders are passed, therefore, it cannot be said that respondents have violated the directions, warranting initiation of contempt proceedings.

As fairly submitted by the learned counsel for the petitioners also, no promotions are taken up to the post of Hostel Welfare Officer, Grade-I in Rangareddy District, after the interim orders are passed. However, the learned counsel submits that deliberately the respondents are delaying the grant of promotions, thereby violating the orders of this court. It may be true that the respondents are not effecting promotions even though vacancies are available, but as per the directions of this court, the respondents cannot be held guilty of violating the directions of this court, since no promotions are effected after the interim orders are passed, ignoring the seniority of the petitioners. Therefore, there is no merit in the claim of the petitioners. The contempt case is accordingly closed. However, it is open to the petitioners to work out their remedies against the inaction of the respondents in effecting promotions, even though vacancies are available.

Interlocutory applications pending, if any, shall stand closed. No costs.
