This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, to quash the proceedings in Cr.No.38 of 2015 of Women Police Station, Begumpet, Hyderabad City, registered for the offences punishable under Sections 498-A, 506 and 406 I.P.C. and Sections 4 and 6 of Dowry Prohibition Act, 1961. Heard both sides.
A1 is the husband of respondent No.2. Petitioner No.1/A2 is the mother, petitioner Nos.2 and 3/A3 and A4 are the sisters and petitioner No.4/A5 is the brother-in-law of A1. Alleging that the accused are harassing her, respondent No.2 filed a complaint before the Women Police Station, Begumpet, Hyderabad City, against the accused. Basing on the same, police registered the aforesaid crime against the accused for the offences punishable under Sections 498A, 506 and 406 I.P.C. and Sections 4 and 6 of Dowry Prohibition Act, 1961.
The allegations in the complaint, prima facie, reveal the commission of offences punishable under Sections 498-A, 506 and 406 I.P.C. and Sections 4 and 6 of Dowry Prohibition Act, 1961 by the petitioners/A2 to A5. This is a matter, which requires investigation by the police, and there are no valid grounds to quash the First Information Report.
Having regard to the facts and circumstances of the case, the
Criminal Petition is disposed of, directing the Investigating Agency to proceed with the investigation, however, without arresting the petitioners/A2 to A5 in connection with Cr.No.38 of 2015 of Women Police Station, Begumpet, Hyderabad City.
Miscellaneous Petitions, if any, pending in this petition shall stand closed.
