HONOURABLE SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1210 OF 2018 ORDER:

This Criminal Petition is filed by the petitioner/accused No.3 in Crime No.139 of 2017 on the file of Repalle Town Police Station, Guntur District, seeking to grant anticipatory bail. The offence alleged is under Section-307 read with 34 IPC.

The case of the prosecution is that this petitioner beat the victim, on his head, causing injuries and that there are some family disputes between the parties, which led to this incident.

Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondent. Perused the record.

Learned counsel for the petitioner submits that accused Nos.1 and 2 in this case were already enlarged on bail and hence, the petitioner may also be granted bail. But, considering the nature of the allegations levelled against this petitioner, this Court opines that he is not entitled for grant of anticipatory bail.

Accordingly, the Petition is dismissed. The petitioner can also seek for regular bail.

As a sequel, the Miscellaneous Petitions, pending if any, stand closed.
