SMT JUSTICE T.RAJANI CRIMINAL PETITION No.5359 OF 2011 ORDER:

This Criminal Petition is filed by the petitioner seeking for quash of the proceedings in D.V.C. No.20 of 2010 on the file of I Additional Judicial First Class Magistrate at Mancherial.

Heard the learned counsel for the petitioner and the learned Public Prosecutor for the 2nd respondent. None appears for the 1st respondent. 3.

The counsel for the petitioner now does not press upon the Petition, as he is satisfied that the Petition is not maintainable for domestic violence cases except when there is no domestic relationship between the petitioner and the 1st respondent. But, however, he seeks for a direction to the Court below not to insist upon the presence of the petitioner on every date of adjournment. Hence, considering the said request, the lower Court is directed not to insist upon the presence of the petitioner unless it is necessary for the proceedings of the Court.

With the above directions, the Criminal Petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. ___________________ T.RAJANI, J Date: 19.12.2017.
