HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 34220 of 2017 Order:
The petitioner is a Rice Miller-cum-Trader in Rice and Paddy. He has been undertaking custom milling of Government paddy. While so, the fourth respondent inspected the Rice Mill and seized 250.5 Quintals of Rice, 9.5 Quintals of broken Rice and 22 Quintals of Paddy. 6-A proceedings taken up and they are pending before the third respondent. Though the case of the petitioner is that the fourth respondent has no authority to inspect the premises and no irregularity was committed, the petitioner filed a petition on 22.08.2017 before the third respondent seeking release of the seized stock, but when the said application was not disposed of by the third respondent, the present Writ Petition is filed. On 12.10.2017, the Writ Petition was adjourned in order to verify whether any orders were passed in the said petition.
Today, when the matter is taken up for admission, learned Government Pleader submitted that no orders were passed in the said petition dated 22.08.2017. In the circumstances, this Writ Petition is disposed of directing the third respondent to consider the petition of the petitioner dated 22.08.2017 and pass appropriate orders in accordance with law within a period of one week from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
