HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 14815 of 2007 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to issue a writ of mandamus declaring the impugned suspension order dated 21.02.2005 issued by the 1st respondent as illegal and arbitrary. A consequential direction is also sought to the respondents to reinstate the petitioner into service forthwith.

Heard Mr. V. Ravichandran, learned counsel for the petitioner, and the learned standing counsel for the respondents. 3.

On 25.07.2007, while admitting the writ petition, this Court granted an interim order of suspension of the orders impugned in the writ petition in W.P.M.P.No. 18645 of 2007.

It is submitted by the learned counsel for the petitioner that consequent upon the interim order dated 25.07.2007, the suspension orders were revoked on 01.08.2007 and the petitioner was reinstated into service, and that the petitioner has already filed a writ petition in W.P.No.4864 of 2016 seeking to treat the period of suspension as on duty with all consequential benefits. Therefore, the cause in the writ petition does not survive for adjudication.

Recording the submission made by the learned counsel for the petitioner, the writ petition is closed. The petitioner is at liberty to pursue W.P.No.4864 of 2016.
