ORDER:

Heard.

2. This writ petition is filed alleging that respondent No.2 is not registering any F.I.R. on the complaint of the petitioners. Though copy of the complaint is not filed, learned counsel for the petitioners states in paragraph 7 of the affidavit, filed in support of the writ petition, that when petitioner No.1 went to register a complaint against respondent No.3, respondent No.2 did not register the same on the ground that it is a family dispute.

3. Instructions of the learned Government Pleader, however, show that no complaint is pending with respondent No.2 and as such no further action can be taken. It is also stated that it is open for the petitioners to approach respondent No.2 and file a complaint if any cognizable offence is made out and after examining the complaint appropriate action in accordance with law will be taken.

4. Hence, the writ petition is disposed of permitting the petitioners to file a fresh complaint before respondent No.2, if any cognizable offence is said to have committed and if such a complaint is received, respondent No.2 will examine the same and take appropriate action thereon in accordance with law.

As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
