CVNR, J CC 568/2016 ORDER:
This contempt case is filed alleging wilful disobedience of order dt.05.02.2013 in W.P. No.3277 of 2013.
By the aforementioned order this Court has restrained the respondents from finalizing the contract in pursuance of tender notice dt.21.01.2013 impugned in the writ petition. At the hearing, Mr. K. Lakshman, learned Assistant Solicitor General, submitted that the period of the contract prescribed under the aforesaid tender notice was only for two years, that after passing of the interim order not only that the tenders were not finalized and the contract was not entrusted to third parties, but also the petitioner was continued as contractor. This fact is not disputed by Mr. Satyam Reddy, representing Mr. Mirza Safiulla Baig, learned counsel for the petitioner. In my opinion, when the very period of the contract prescribed in the tender notice impugned in the writ petition has expired, entrustment of work to a third party much thereafter does not constitute contempt of the interim order of this Court. Accordingly, the contempt case is dismissed.
