SMT JUSTICE T.RAJANI CRIMINAL PETITION No.8770 OF 2011 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioner/A-1 seeking to quash the proceedings in Crime No.83 of 2011 of Karapa Police Station, West Godavari District, registered for the offences punishable under Sections 498-A R/w. 34 of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard learned counsel for the petitioner, learned Public Prosecutor, appearing for the 1st respondent- State, and learned counsel for the 2nd respondent - de-facto complainant.

Learned counsel for the petitioner submits that the parties have compromised the matter. Learned counsel for the 2nd respondent also affirms the said contention.

Learned counsel for the petitioner also filed the copies of the Memorandum of the terms of compromise, entered between the parties, and the order copy in O.S. No.939 of 2011, dated 18.02.2013, on the file of the Court of III Additional Senior Civil Judge, Kakinada; wherein the compromise was recorded.

A perusal of the Memorandum of terms of compromise would show that there was an agreement that this case also should be withdrawn by the petitioner.

Hence, considering the above, this Court opines that continuation of further proceedings against the petitioner would only be an abuse of process of law.

Accordingly, the Criminal Petition is allowed and all further proceedings against the Petitioner/A-1 in Crime No.83 of 2011 of Karapa Police Station, West Godavari District, are hereby quashed.

As a sequel, miscellaneous petitions if any, pending in this Petition shall TR,J Crl.P. No.8770 of 2011 stand closed.
