THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7652 OF 2016 ORDER:

This petition is filed by the petitioners-A1, A2 and A3 under Section 438 Cr.P.C. seeking to grant bail in Crime No.573 of 2014 on the file of Chikkadpally Police Station, registered for the offence punishable under Sections 3(1)(x) of SCs & STs (POA) Act, 1989 and Section 506 IPC.

It is alleged that the petitioners asked the de facto-complainant to sell his property, for which he refused. Then the petitioners started harassing the de facto complainant and his family members. It is also alleged that the petitioners came to the house of the de facto complainant and abused him and threatened that they will not allow the de facto complainant to build the house.

Learned Counsel for the petitioners submitted that the petitioners are no way concerned with the alleged offence and that the allegations against the petitioners are baseless. The learned Additional Public Prosecutor opposed this petition and submitted that in view of the nature of the offence, this petition for anticipatory bail is not maintainable.

Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor and in view of the nature of the offence and the allegations, this Court is of the view that this petition is not maintainable.
