HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27981 OF 2017 ORDER:
The petitioner was appointed as permanent fair price shop dealer of shop No.22 of Poolachintha Village, Nandavaram Mandal, Kurnool District, by proceedings dated 03.11.2009 by the third respondent. The authorization of the petitioner was valid till 31.03.2018. While so, on the report submitted by the Mandal Revenue Inspector, Nandavaram, to the respondents 2 and 3, the proceedings under Section 6-A of the Essential Commodities Act are taken up for the irregularities reported against the petitioner. The third respondent issued a show cause notice on 06.02.2017 framing three charges against the petitioner and after conducting enquiry, cancelled authorization by proceedings dated 27.05.2017. Against the same, the petitioner preferred an Appeal to the second respondent on 17.06.
2017 and when the same is not disposed of, the present writ petition is filed. Though the learned counsel for the petitioner pointed out various infirmities in the order of cancellation of authorization, this Court is not inclined to go into the merits of the case as the Appeal is pending before the second respondent against the impugned order dated 27.05.2017. A perusal of the charges framed against the petitioner shows that the charges are minor in nature. In the circumstances, the second respondent shall dispose of the Appeal on the basis of the record and after hearing the petitioner, within a period of two months from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 22.08.2017 pln
