HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20950 of 2017 ORDER:

This writ petition is filed by petitioner seeking to direct respondents Nos.2 and 3 to consider his application for regularization of temporary constructions.

The case of the petitioner is as follows:

The petitioner purchased plot Nos.80, 81, 42 and 41 admeasuring 500 sq. yards of each plot in Sy.No.65 of Nagaram village, Keesra Mandal, under registered sale deed dated 9.11.2012. He constructed a temporary shed in an area of 2800 sft for the purpose of his residence. While so, at the instigation of respondents Nos.5 to 7, who are land grabbers, the 3rd respondent issued a notice stating that the petitioner erected temporary shed without obtaining permission. On receipt of the notice, the petitioner submitted a reply-cum-application on 24.6.2017 for regularization of construction of temporary shed. No orders have been passed so far. Meanwhile, respondents Nos.4 to 7 are proclaiming that the shed of the petitioner will be demolished. Hence, the petitioner filed this writ petition. 3.

Heard and perused the material available on record. 4.

The main grievance of the petitioner is that he made an application for regularization of construction of temporary shed in the subject property and the respondents Nos.2 and 3 have not passed any orders so far. Meanwhile, the unofficial respondents are proclaiming that the official respondents will demolish the shed.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

"Respondents Nos.2 and 3 are directed to consider the application of the petitioner for regularization of construction of temporary shed in the subject property and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order. Till then, the official respondents are directed not to take any coercive steps in connection with the temporary shed constructed by the petitioner in the subject property."

With the above direction, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs. ________________ RAJA ELANGO, J Date: 28th June, 2017 Nn
