THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No.148 OF 2010 O R D E R:

This Company Petition is filed invoking the provisions of Sections 433(e)(f), 434(1)(a) and 439 of the Companies Act, 1956 read with Rule 95 of the Company (Court) Rules, 1959, alleging the inability of the respondent-company to pay the admitted debts. After issuance of the notices respondent had come forward and both the parties negotiated and arrived at a settlement and entered into a compromise on today and both the learned counsel prays the Court to close the Company Petition in view of the settlement reached.

Having considered the respective submissions and in view of the settlement reached between the parties the Company Petition is closed in terms of the compromise memo filed by both the parties today. However, in the event there is any grievance in future, it is left open to the petitioner to enforce his rights in accordance with law. No order as to costs.
