HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43738 OF 2016 ORDER:

The case of the petitioner is that he is the owner of the land admeasuring Ac.5.39 guntas, situated at Anthansagar Village, Kondapur Mandal, Medak District. While so, when 3rd parties tried to interfere with the subject property, the petitioner filed a Civil suit in O.S.No.72 of 2016 and the Civil Court was pleased to grant status-quo order on 30.03.2016 in I.A.No.322 of 2016. In spite of having interim orders in favour of the petitioner, the 2nd respondent is trying to interfere with the possession of the petitioner, without following due process of law. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue on instructions dated 18.12.2016 issued by the 2nd respondent submits that the subject lands are private lands and that the 2nd respondents never interfered with the possession of the petitioner. It is also stated that the Government has no interest in the issue involved in respect of the subject lands.

Recording the instructions issued by the 2nd respondent, the writ petition is disposed of. However, this order will not have any impact on the inter se disputes between the petitioner and the 3rd parties. No costs.
