T. Ramadas, v. Sri Gandhe Kishan Prasad Rao
HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY CONTEMPT CASE No.175 of 2015 Date:13.02.2015 Between:
T.Ramadas, S/o T.V.S.Sastry ..... Petitioner And:
Gandhe Kishan Prasad Rao, S/o Narsing Rao
...Respondent
Counsel for the Petitioner: Party-in-person Counsel for the Respondent: -- The Court made the following:
ORDER:
This Contempt Case is filed by respondent No.1 in Civil Revision Petition Nos.1031 and 1032 of 2011 alleging that the petitioner in the said Civil Revision Petitions has not complied with order, dated 23.02.2012, passed by this Court in the said Civil Revision Petitions, by not paying the costs of Rs.5,000/- imposed in each of the two Civil Revision Petitions. The party-in-person, who has represented himself, at the hearing, has stated that he is not aware of the legal requirement of filing costs memo for execution of the order relating to imposition of costs.
In my opinion, no Contempt Case can be maintained for non-payment of the costs awarded in the order of this Court. The petitioner ought to have
executed the order after filing costs memo. Hence, I do not find any merit in the Contempt Case and the same is, accordingly, dismissed.
