CVNR, J & GSP, J WP 3404/2018 ORDER: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus directing respondent Nos.2 and 3 to produce Mr. B. Chandra Shekar, S/o. B. Bikshapathi ("the alleged detenu") before the Court and hand over his custody to the petitioner.

Respondent No.2 filed a counter affidavit wherein he has inter alia averred that the alleged detenu is accused in Crime No.133 of 2018 registered for the offences under Sections 409 and 420 IPC and Section 24 of the Immigration Act, 1983 of L.B. Nagar Police Station, Rachakonda Commissionerate. That in connection with the said crime, he was arrested by the L.B. Nagar Police on 2.2.2018 at Kamineni X Roads, L.B. Nagar, Hyderabad, that after complying with the formalities of arrest, he was produced before the II Metropolitan Magistrate, L.B. Nagar, Hyderabad, on the same day and that the learned Magistrate remanded him to judicial custody. It is further stated that in pursuance of the remand order, the alleged detenu is lodged in Central Prison, Cherlapally.
