W.P.No.41110/2016 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) The petitioner, who was issued with a charge memo in the year 2004 and on account of which he was not granted promotion to the post of Assistant Director of Town and Country Planning, approached the Tribunal and filed O.A.No.4074 of 2016. The petitioner also sought an interim direction to consider his case for promotion without reference to the charge memo. But the Tribunal merely admitted the Original Application and did not grant interim direction. Therefore, the petitioner has come up with the present writ petition challenging the order of the Tribunal.

When a charge memo is under challenge there cannot be any interim direction, pending disposal of the Original Application, to promote a person without reference to the charge memo. Any promotion will be only subject to the outcome of the Original Application. Therefore, the Tribunal was right in not granting an ex parte interim order. Hence, the writ petition is dismissed.
