THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.2274 OF 2017 ORDER:

Heard learned counsel for the petitioner, who submitted that though notices were sent to the respondents 5 to 7, acknowledgements have not been received. Even without receiving acknowledgements and without waiting for the presence of the respondents 5 to 7, this writ petition is being disposed of in view of the nature of disposal of the present writ petition, which does not affect the rights of the respondents 5 to 7.

The case of the petitioner is that his grand father was owner and possessor of land admeasuring Ac.09.17 guntas situated in Basanthpur village, Rajampet Mandal, Yadadri District. His name was entered in the revenue records. His father by name Chukka Reddy, died in the year 1983 and he succeeded to the said property. While so, the petitioner came to know that the names of the respondents 5 to 7 were entered in the revenue records from the year 2013-14 onwards in respect of the said land. The petitioner submitted a representation on 05-01-2017 to the respondents 2 and 3 requesting them to take action against the respondents 5 to 7 by duly removing their names and enter the name of the petitioner. When no action was taken, the present writ petition is filed. 3.

The issue raised in this writ petition is covered by the provisions of the A.P. Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act') and the petitioner can take action in accordance with the provisions of the Act. In view of the same, liberty is given to the petitioner to take appropriate proceedings in accordance with the provisions of the Act and on receipt of the same, the competent authority shall pass

appropriate orders in accordance with law after hearing the respondents 5 to 7.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
