HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8025 of 2017 ORDER:
Heard the learned counsel for the petitioner who is the A.3 in Cr.No.122 of 2017 on the file of the Boothpur Police Station, Mahaboobnagar, registered for the offences punishable u/sec.420,487,120-B IPC, Section 7 of the Seeds Act, E.P.Act 1986 rule (7) r/w 1989 and also the learned Public Prosecutor representing the respondents, the Station House Officer, the Agricultural Officer(Tech) and Asst. Director of Agriculture. Perused the quash petition averments and the contents of the FIR from the disclosure statement of A.1 and A.2 and there is no basis for the so called disclosure of A.3-the petitioner herein and according to the learned counsel for the petitioner also it is a false implication.
In fact, it is premature to come to conclusion but for to say investigation shall go on but there is nothing to admit the petition and keep the same pending.
Accordingly and in the result, the Criminal Petition is disposed of with an observation that investigation shall go on and the petitioner shall not be arrested but it will not prevent from securing presence of the petitioner for investigation. Consequently, miscellaneous petitions, if any shall stand closed.
