Petition filed under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petjtion, the High Court may be pleased to enlarge the petitioners on bail pending investigation enquiry and trial into Crime No. 191 of 2017 , of I Town Police Station Adoni. The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri K. Sitaram, Advocate for the Petitioners and ot Public Prosecuto(AP) on behalf of Respondenlstate, the Court made the following ORDER :-

SMT JUSTICE T. R-AJANI CRIMINAL PETITION No,1211 of 2018 ORDER:

This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1,973, seeking to enlarge the petitioners, who are A1 to 44, on bail in Crime No.191 of 2OI7 on the file of the Station House Officer, I Town police Station, Adoni.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The counsel For the petitioners submits that the case of the prosecution is that the petitioners herein beat the deceased on a suspicion that he was a thief and the said beating was only with sticks. Initially, the case was registered for the offence under Section 323 IPC and later it was converted to Section 302 IPC since the deceased died.

Hence, going by the facts of the case, it appears that there was no intention on the part of the petitioners to commit the m urder of the deceased.

Hence, considering the above circumstances, the Criminal Petition is allowed and the petitioners are directed to be enlarged on bail on condition of each of their executing personal bonds for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the ludicial

Magistrate of First Class, Adoni, and to appear before the trial Court on the dates given by the concerned Court. As a sequel, the miscellaneous applications, if any pending, sha ll stand closed.
