THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.3511 of 2018 ORDER:
When the matter is taken up for hearing, written instructions, dated 06-02-2018, furnished by the Sub-Inspector of Police, Hayathnagar Police Station, Rachakonda Commissionerate are placed on record by the learned Government Pleader for Home. As such, instructions to the extent of their relevancy read as under: - "On a complaint of the petitioner dated 8.6.2017 lodged with the Police of Hayathanagar Police Station, Rachakonda Commissionerate, a case in Cr.No.456/2017 U/sec.306 IPC was registered against Smt.Erukala Nagamani as she is responsible for the death of his son who committed suicide on 7.6.2017 to a ceiling fan and taken up the investigation into the case.
During the course of investigation into the case, the investigation officer examined as many as 10 witnesses and recorded their detailed statements. As per the statements of the witnesses, prima facie case is clearly made out that the accused Smt.Erukala Nagamani has committed the offence punishable U/sec.306 IPC and hence she was arrested on 17.6.2017 and after following the due procedure, she was sent for remand.
The Asst. Commissioner of Police, Vanasthalipuram Division has already addressed letters dated 6.11.2017 and 21.12.2017 to the Director, Forensic Science Laboratory, Red Hills, Nampally, Hyderabad to send the FSL report to enable the investigating agency to proceed with further course of action into the case. Final opinion from the FSL authorities is pending. The report of the FSL is awaited.
I humbly submit that as soon as the FSL report is received, appropriate report either final report or charge sheet will be filed before the concerned Hon'ble Court at the earliest, for which, I pray this Hon'ble Court to grant some more time to the investigating agency.
It is pertinent to submit that the investigation is completed. The accused Smt.E.Nagamani was arrested and sent for remand. FSL report is awaited. Reminders were also sent to the FSL authorities to send the report. As soon as the report is received from the authorities, appropriate report will be filed into the Hon'ble Court. Having regard to the above instructions and taking into consideration the submission of the learned counsel for the petitioner and learned Government Pleader for Home, this court deems it appropriate to dispose of the writ petition by placing on record the
above mentioned written instructions with a further direction to the police authorities to complete the investigation as early as possible. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
